5.10. Section 360, Code of Criminal Procedure, 1973.-

In areas where the Probation of Offenders Act, 1958 does not apply, section 360 of the Code of Criminal Procedure, 1973 regulates the topic of release of offenders on probation. Amendments in that section could, wherever necessary, be made on the same lines as those suggested above, in the Probation Act. However, as a matter of criminological policy, it would be preferable to bring the whole of India within the scope of the Probation of Offenders Act.
