1.26. Three types of under-trial prisoners.-

There are three types of under-trial prisoners who are inmates of jails:

(1) Persons being tried for non-bailable offences in respect of whom the courts have declined to pass an order for their release on bail.

(2) Persons being tried for non-bailable offences, in respect of whom courts have passed order for bail but who, because of the difficulty of finding appropriate surety or because of some other reason, do not furnish the bail bond.

(3) Persons who are being tried for bailable offences but who, because of the difficulty of finding appropriate surety or because of some other reason do not furnish the bail bond. It is plain that if we want to reduce the burden of under-trial prisoners on jails we shall have to deal with all the above three categories.
