Alternative remedy

5.38. The Supreme Court also observed that in accordance with the rule laid down by the court in Union of India v. T.R. Varmal, AIR 1957 SC 882, be writ petition could have been dismissed on the ground that it was lot the practice of courts to decide such disputed questions of fact in proceedings under Article 226 of the Constitution. Other proceedings are more appropriate for a just and proper decision of such question.
