5.9. Two Acts on the subject.-
The (U.K.) Foreign Enlistment Act, 1870 applies only when the recruiting is for the service of any foreign State at war with any foreign State at peace with the Government. The Foreign Recruiting Act, 1874, on the other hand, authorises the Government to prohibit or regulate recruitment in India for any type of foreign service. As the wider of the two, it may be discussed first.
