4.2. Assisting India's enemies.-

The most direct of such threats arises from the act of giving assistance to India's enemies. In our Report1 on the Penal Code, we have brought out the defect in the existing law on the subject, and recommended the insertion of a provision for punishing a person who assists India's enemies or the armed forces of a country whose armed forces are engaged in hostilities with India, whether or not war has been declared between that country and India. It is appropriate that provision should form the first section in the group of sections with which we are now concerned.
