6.14. Role of Chief Justice.-

Another question which has engaged attention is as to whether the role of the Chief Minister should be that of commencing on the name recommended by the Chief Justice, or whether, in case he disagrees with the recommendation of the Chief Justice, he (the Chief Minister) can also suggest another name. This question was agitated in the past, and after due consideration it was decided1 that the Chief Minister would be entitled, in case he disagrees with the recommendation of the Chief Justice, to suggest another name. The Chief Minister in such an event has to invite the comments of the Chief Justice and send the matter thereafter along with the comments of the Chief Justice, to the Union Minister of Law and Justice. In view of the fact that a decision referred to above has already been taken after due consideration, we need not say anything further in the matter.
