25. Statutory duties and powers.-

Before considering sections 2(2) and 2(3) of the Crown Proceedings Act, which relate to the liability of the Crown with regard to statutory duties and powers, it is necessary to bear in mind the nature of the liability that arises in this connection. It is unnecessary to refer to the decisions which deal with this matter elaborately and it will be sufficient to refer to two decisions which have settled the law in England.
