XXIII. Judicial Proceeding

A. Introductory

6.58. Judicial proceeding.-

We shall now deal with the term "judicial proceeding", which has not been defined in the Act. It may be noted that the very section which deals with the application of the Act-section 1, second paragrap.-provides that the Act applies to all "judicial proceedings" before the specified "courts". The expression "judicial proceeding" occurs also in sections 33 and 80. We shall first refer to the important case-law under the Evidence Act, then to definitions as given in a few other Acts or in some decided cases, and then record our own conclusions.
