33. Section 9.-

Both proposal and acceptance may take place without express words. Hence the rule that a promise may be express or implied. The section assumes the existence of the rule, but does not lay it down. As it stands at present, it is merely a defining section. We suggest that it should categorically state the rule.

34. Section 10.- No change is necessary in section 10.
