5. Only one suit permissible.-

Not more than one suit shall lie under this Act for and in respect of the same cause of action.1-2

1. Period of limitation for a suit under the Fatal Accidents Act is two years under Article 82, Limitation Act, 1963. (It was one year under Article 21, Limitation Act, 1908).
