10.5. Recommendation as to section 42, clause (a).-

No changes of substance appear to be needed in section 42, but it may be useful to provide in clause (a) that the notice could be delivered to the agent of the person to be served who is empowered to accept service. The reasons for making this amendment hardly need be elaborated. In order to avoid abuse, we would confine the amendment to the Government, local authorities and corporations. Accordingly, we recommend that in section 42(a), the words "in the case of a Government, local authority or corporation, to a person duly empowered to accept service on its behalf, or" should be added at the end.
