Employees’ State Insurance Act, 1948

86. Prosecutions

(1) No prosecution under this Act shall be instituted except by or with the previous sanction of the Insurance Commissioner 39[or of such other officer of the Corporation as may be authorized in this behalf by the 129[Director-General of the Corporation]].

130 [(2) No court inferior to that of a Metropolitan Magistrate or Judicial Magistrate of the First Class shall try any offence under this Act.]

(3) No court shall take cognizance of any offence under this Act except on a complaint made in writing in respect thereof 131[* * *].
