Overview of Competition Law:
Need for Competition? If we look back in time - may be ten, twenty or thirty years or even more - some observations are compelling indeed. Barring exceptions, the quality of life as well as life expectancy is improving. The phrase 'quality of life' encompasses a lot-every day gadgets, means and width of sources of entertainment, quality of drugs and healthcare, variety and quality of the tools to satisfy the creative and exploratory urges of the human intellect and all that which contributes to make life more meaningful and fulfilling. This is nothing but what a civilized and enlightened society would like to desire for its citizenry.
How it came about? There were times when the centralized planning was considered to help in universal and wide fulfillment of wants of the population. History proved that this type of planning could not sustainably establish itself. On the contrary, more reliance on the market forces, over a period of time, not only responded to the needs of the masses in real time but also ensured that the stakeholders who contributed to the needs of the population also benefitted by way of profits in the process of catering to the increasing demands of various goods and services. These stake holders included the inventors, copy rights holders, manufactures, distributors, service providers and consumers of goods and services. This system of reliance on market forces, as opposed to centralized planning, is popularly known as 'capitalism'.
