HC debars Bar Council from publishing AIBE results
The Calcutta High Court on 24th Dec, 2011 directed the Bar Council of India not to publish the result of All India Bar Examination - the entrance test taken by the lawyers to get themselves registered for practising law in the courts.
Hearing the petition challenging the notification issued by the Bar Council of India, Justice Jayanta Kumar Biswash said the Bar Council of India can hold the examination as scheduled for January 2012 but the result would not be published according to the order of the Calcutta High Court.
In June 2010, the Bar Council of India introduced the entrance examination making it mandatory for any lawyer to pass the exam before beginning their practice in courts.
The notification issued by the Bar stated that the examination would test the analytical abilities and basic knowledge of law of the candidates who completed the law course. Debarj Mallick, who could not begin his practice after completing law filed a writ petition in the high court challenging the bar's notification.
Moving the petition Debasish Banerjee, counsel of Debraj, contended that the notification was unconstitutional and it was against the Advocate Act. According to the legal provision, he said, anybody could start practice after the registration with the state bar councils.
Following such submissions, Justice Biswash asked the Bar Council of India to file an affidavit within four weeks.
