Shankarrao Chavan Law College, Pune is going to organize the one day National Seminar on 'Public Health Care System in India: Issues and Challenges'

About the Seminar:

  • Universal Declaration of Human Right declares the health as part of the right to an adequate standard of living. International Covenant on Economic, Social and Cultural Rights, Art. 12 states that the State parties to the present Covenant recognize the right of everyone to the enjoyment of the highest attainable standard of physical and mental health.
  • India is an active member of ICESCR. Art. 12 expects the States that necessary steps would be taken to prevent, treat and control an epidemic, endemic, occupational and other diseases and also create conditions that would assure all medical services and medical attention in the event of sickness.
  • Public Health Laws are the study of the legal powers and duties of the state to ensure the conditions for people to be healthy (eg. to identify, prevent and ameliorate risks to health and safety in the population), and the limitations on the power of the state to constrain the autonomy, privacy, liberty, proprietary or other legally protected interests in individuals for protection and promotion of community health.
  • It is the legal obligation of the state to accord adequate health care systems for the promotion and protection of public health. Hence, the study of public health law becomes more relevant and appropriate.
  • The Apex Court in the case of Francis Coralie Mullin vs. The Administrator, Union Territory of Delhi 8 that the right to life has a very broad scope which covers the right to livelihood, better standard of life, hygienic conditions in the workplace, and right to leisure.
  • Right to Health is, therefore, an inherent and inescapable part of a dignified life. The idea perceived as the right to health encompasses freedoms and entitlements. Freedom covers the right to control one's health and the concept of the right to health relates to the right to be free from interference, such as the right to be free from torture, non-consensual medical treatment, and experimentation.
  • Inadequate public health care system, less attention towards public health care system by the state, shortage of medical accessories, infrastructure, medicines, human resources, medical practitioners, lack of advanced medical equipment's etc. have been experienced by the public before and during pandemic particularly.
  • In addition to this, public health care system is very weak to provide medical treatment to newly emerged diseases. Therefore, keeping in mind the broader aspects of the various legal and social issues involved in access to public health care system, it is necessary to discourse the lacunas exists in several public health laws in the context of state's obligation to provide public health care system and public's right to health. This seminar mainly concentrates upon these issues.

Objectives of the Seminar:
The Seminar is an attempt to open a platform for jurists, academicians, advocates, research scholars, and students to converse and exchange ideas pertaining to legal and social issues involved in access to the public health care system for the betterment of the societal members.

  • To get acquainted with the Public Health Care Systems in India
  • To understand the legal scenario at the International and National level
  • To comprehend the legal and social issues pertaining to access to public health care system
  • To understand the several legal and social issues relating to access to public health care system and probable elucidation to resolve them

Papers are invited from the Academicians, Practitioners, Students of Law, and Research Scholars on the given sub-themes.

Formatting and Submission Guidelines:

  • All submissions should be in English.
  • The main text should be in A4 size, Times New Roman Font on MS-Word, dully typed in 12pt Font size with 1.5 Line Spacing.
  • The paper should be between 3000-5000 words.
  • Co-Authorship is permitted with a maximum of 2 authors only.
  • The citation method to be followed is JILI

Registration Fee:

  • Academicians, Lawyers, Law students, and Research Scholar: No fees (only participation)
  • Academicians, Lawyers, and other professionals Law students, and Research Scholar other than SCLC (Research paper presentation): INR 400/-

Note:Registration fees include only participation/paper presentation certificates. The co-authorship up to two is allowed, however, the co-authors are required to register separately with full fees.
